Members can make complaints about any area of the organisation’s activity. Members should speak to the Chairman or Vice Chairman about any concerns\u0026nbsp;\u003cstrong\u003eor they should follow the complaints procedure laid out in the Disciplinary Code\u003c/strong\u003e. If a member is not happy with the explanation they receive, the complaint should be made in writing to the Members Liaison Officer (MLO). The MLO will aim to send a full reply within two weeks of receiving the written complaint. If this is not possible because, for example, an investigation is being carried out, the member will be notified of when to expect a full reply. If something has been done incorrectly or a mistake has been made, an apology will be made. The MLO will explain what went wrong and how it is being put right. The MLO may also, in their absolute discretion, refer matters to the Chairman of the Endurance GB Disciplinary Panel under paragraph 3 of the Disciplinary Code below.\u003c/p\u003e\n\u003cp\u003e\u003cspan style=\"font-size: 16px;\"\u003e\u003c/span\u003e\u003c/p\u003e\n\u003cp\u003e\u003ca name=\"code\"\u003e\u003c/a\u003e\u003c/p\u003e\n\u003cp\u003e\u0026nbsp;\u003c/p\u003e\n\u003cp\u003e\u003cstrong\u003eThe Disciplinary Code\u0026nbsp;\u003c/strong\u003e\u003c/p\u003e\n\u003cp\u003e\u003c/p\u003e\n\u003cp\u003e\u003cstrong\u003e\u003cspan style=\"font-size: 16px;\"\u003ePlease Note this Code is taken from the Members\u0027 Handbook\u003cbr\u003e\n\u003c/span\u003e\u003c/strong\u003e\u003cstrong\u003e1.\u003c/strong\u003e \u0026nbsp;\u0026nbsp; \u003cstrong\u003eIntroduction\u003c/strong\u003e\u003c/p\u003e\n\u003cp style=\"margin-left: 39.6pt;\"\u003e1.1.\u0026nbsp;\u0026nbsp;\u0026nbsp; This Disciplinary Code forms part of the terms and conditions of membership of Endurance GB (“EGB”).\u0026nbsp; It also forms part of the terms and conditions of participation in rides, competitions and other events organised and/or sanctioned by Endurance GB (“EGB Rides”).\u0026nbsp; Anyone who applies for membership of EGB, and/or who participates in an EGB Ride, whether as a competitor, crew, trainer, owner, official or any person assisting any competitor, shall be deemed to have accepted this Code and agreed to be bound and to abide by its provisions and all decisions made hereunder.\u003c/p\u003e\n\u003cp style=\"margin-left: 39.6pt;\"\u003e1.2.\u0026nbsp;\u0026nbsp;\u0026nbsp; EGB may from time to time supplement, amend or vary this Code.\u0026nbsp; Such changes shall be deemed to be effective and binding from the date of publication of the changes by EGB.\u0026nbsp; The Code presented below for 2014 is a revised version of the previous (original) Code, although the main principles still apply.\u003c/p\u003e\n\u003cp style=\"margin-left: 39.6pt;\"\u003e1.3.\u0026nbsp;\u0026nbsp;\u0026nbsp; The following pages provide a summary of the Disciplinary Code and the EGB Disciplinary Committee’s procedure for considering appeals against decisions by Technical Stewards/Ground Juries.\u0026nbsp; The full version of the Code can be found on the EGB website and should be read before raising a complaint or grievance with EGB.\u0026nbsp; A printed copy can be provided on request from the EGB Office.\u003c/p\u003e\n\u003cp style=\"margin-left: 39.6pt;\"\u003e1.4.\u0026nbsp;\u0026nbsp;\u0026nbsp; The British Equestrian Federation (BEF) has responsibility for handling disciplinary matters for riders and their connections at all international events whether they are staged in the UK or outside it, subject to the rules and procedures set out in the BEF Rule Book. \u0026nbsp;In addition, the BEF Equine Anti-Doping and Controlled Medication Rules apply to all EGB Rides, not just at FEI Rides in England and Wales.\u0026nbsp; Positive tests from any EGB or FEI Rides will be handled by the BEF.\u0026nbsp;\u003c/p\u003e\n\u003cp style=\"margin-left: 18pt;\"\u003e\u003cstrong\u003e2. \u0026nbsp;\u0026nbsp; \u003c/strong\u003e\u003cstrong\u003eDisciplinary Offences and Disciplinary Complaints\u003c/strong\u003e\u003c/p\u003e\n\u003cp style=\"margin-left: 39.6pt;\"\u003e2.1.\u0026nbsp;\u0026nbsp;\u0026nbsp; Everyone subject to this Code is responsible and accountable for his or her own conduct in connection with the sport of Endurance Riding.\u0026nbsp; They must conduct themselves at all times in accordance with the highest standards of disciplined and sporting behaviour.\u0026nbsp; Any conduct that falls below these standards and that harms or undermines the sport in any way shall constitute a Disciplinary Offence under this Code.\u003c/p\u003e\n\u003cp style=\"margin-left: 39.6pt;\"\u003e2.2.\u0026nbsp;\u0026nbsp;\u0026nbsp; It is not possible to draw up a definitive and exhaustive list of types of conduct, behaviour, statements or practices that may amount to a Disciplinary Offence under this Code.\u0026nbsp; For purposes of illustration only, and not by way of limitation, each of the following types of behaviour may constitute a Disciplinary Offence under this Code\u0026nbsp;\u003cstrong\u003eagainst which Endurance GB can and do take disciplinary action\u003c/strong\u003e::\u003c/p\u003e\n\u003cp style=\"margin-left: 60.7pt;\"\u003e2.2.1. Acts/omissions that breach EGB rules, including the rules specific to any particular EGB Ride;\u003c/p\u003e\n\u003cp style=\"margin-left: 60.7pt;\"\u003e2.2.2. Acts or statements that are, or conduct that is, discriminatory by reason of age, gender, sexual orientation, race, nationality, ethnic origin, colour, religion or disability;\u003c/p\u003e\n\u003cp style=\"margin-left: 60.7pt;\"\u003e2.2.3. Any conduct, behaviour, statements or practices during an EGB Ride that is offensive, indecent, violent and/or insulting and/or that brings or may bring into disrepute the sport of Endurance Riding;\u003c/p\u003e\n\u003cp style=\"margin-left: 60.7pt;\"\u003e2.2.4. Any inappropriate use of Facebook and/or Twitter and/or other social networks regarding EGB members and/or events that is indecent and/or insulting and/or that brings or may bring into disrepute the sport of Endurance Riding;\u003c/p\u003e\n\u003cp style=\"margin-left: 60.7pt;\"\u003e2.2.5. Reneging on any commitment made to participate in EGB teams, such as the commitment made by those persons selected to be members of the World Class Squads to participate, if certain conditions are met, in Endurance Riding Championships and other competitions;\u003c/p\u003e\n\u003cp style=\"margin-left: 60.7pt;\"\u003e2.2.8. Failing to make timely payment for ride entry fees and other amounts due to EGB.\u0026nbsp;\u003c/p\u003e\n\u003cp style=\"margin-left: 18pt;\"\u003e3. \u0026nbsp;\u0026nbsp; \u003cstrong\u003eAppeals against Decision of Technical Steward/Ground Jury\u003c/strong\u003e\u003c/p\u003e\n\u003cp style=\"margin-left: 39.6pt;\"\u003e3.1.\u0026nbsp;\u0026nbsp;\u0026nbsp; Should a person wish to query a decision of the Technical Steward/Ground Jury at an EGB Ride, if possible they should discuss this with the Technical Steward/Ground Jury at the event.\u0026nbsp; \u003c/p\u003e\n\u003cp style=\"margin-left: 39.6pt;\"\u003e3.2.\u0026nbsp;\u0026nbsp;\u0026nbsp; If it is not possible to resolve this query through such discussion at the event, the person should contact the Members’ Liaison Officer (MLO) to appeal from the decision as soon as possible after the event (ideally within 7 days of their discussion with the Technical Steward/Ground Jury at the event). \u003c/p\u003e\n\u003cp style=\"margin-left: 39.6pt;\"\u003e3.3.\u0026nbsp;\u0026nbsp;\u0026nbsp; Should a person wish to appeal from a decision of the Technical Steward/Ground Jury after the conclusion of an event, they should contact the MLO as soon as possible (and within 28 days of the end of the event).\u003c/p\u003e\n\u003cp style=\"margin-left: 39.6pt;\"\u003e3.4.\u0026nbsp;\u0026nbsp;\u0026nbsp; If the MLO is unable to resolve the issue, the person wishing to appeal should deposit £50 with the EGB Office, accompanied by a statement of the reason(s) for their appeal.\u003c/p\u003e\n\u003cp style=\"margin-left: 39.6pt;\"\u003e3.5.\u0026nbsp;\u0026nbsp;\u0026nbsp; This statement will be forwarded to the Chair of the EGB Disciplinary Committee, who will convene a three-person Appeal Panel from the Committee’s members to consider the matter and make a decision. \u003c/p\u003e\n\u003cp style=\"margin-left: 39.6pt;\"\u003e3.6.\u0026nbsp;\u0026nbsp;\u0026nbsp; If the appeal is not upheld, the deposit is forfeited.\u0026nbsp;\u003c/p\u003e\n\u003cp style=\"margin-left: 18pt;\"\u003e\u003cstrong\u003e4. \u0026nbsp;\u0026nbsp; \u003c/strong\u003e\u003cstrong\u003eDisciplinary Proceedings\u003c/strong\u003e\u003c/p\u003e\n\u003cp style=\"margin-left: 39.6pt;\"\u003e4.1.\u0026nbsp;\u0026nbsp;\u0026nbsp; These are summarised in the Boxes below;\u003c/p\u003e\n\u003cp style=\"margin-left: 39.6pt;\"\u003e4.2.\u0026nbsp;\u0026nbsp;\u0026nbsp; Where possible, complaints and grievances should be handled without recourse to the Disciplinary Committee.\u0026nbsp; Bringing complaints arising from EGB Rides to the attention of the Disciplinary Committee should not be undertaken lightly, and other avenues should generally be explored fully before doing so.\u0026nbsp; However, it is recognised that in certain circumstances a complaint should be considered by the Disciplinary Committee and if this is necessary it is important to act promptly.\u0026nbsp; The Members’ Liaison Officer (MLO) should usually be the first contact for non-Ride-related complaints and grievances.\u0026nbsp; \u003c/p\u003e\n\u003cp style=\"margin-left: 39.6pt;\"\u003e4.3.\u0026nbsp;\u0026nbsp;\u0026nbsp; Only a few EGB personnel are able to bring complaints to the attention of the Disciplinary Committee (via its Chair).\u003cstrong\u003e\u0026nbsp;\u0026nbsp; \u003c/strong\u003eThey may be acting on their own behalf or on behalf of an EGB Member. \u0026nbsp;They are:\u003c/p\u003e\n\u003cp style=\"margin-left: 60.7pt;\"\u003e4.3.1. The Technical Steward (TS)/Chair of Ground Jury (GJ) \u003c/p\u003e\n\u003cp style=\"margin-left: 60.7pt;\"\u003e4.3.2. The Members’ Liaison Officer (MLO)\u003c/p\u003e\n\u003cp style=\"margin-left: 60.7pt;\"\u003e4.3.3. The Chef \u003cspan class=\"SpellE\"\u003ed’Equipe\u003c/span\u003e – about matters pertaining to the Development Squads and International Teams\u003c/p\u003e\n\u003cp style=\"margin-left: 60.7pt;\"\u003e4.3.4. The EGB Welfare Officer (EGBWO) – about matters relating to the welfare and safeguarding of\u0026nbsp; EGB Members (especially children and young people) at any event\u003c/p\u003e\n\u003cp style=\"margin-left: 60.7pt;\"\u003e4.3.5. The Disciplinary Representative on the EGB Board of Directors (DREGBBD) (to be nominated by the Board of Directors) – about EGB-related equine welfare concerns arising outside national EGB Rides (where they should be raised with the TS)\u003c/p\u003e\n\u003cp style=\"margin-left: 60.7pt;\"\u003e4.3.6. The DREGBBD should only become involved in bringing any other types of complaint to the Disciplinary Committee after all other relevant possibilities have been explored.\u003c/p\u003e\n\u003cp style=\"margin-left: 39.6pt;\"\u003e4.4.\u0026nbsp;\u0026nbsp;\u0026nbsp; EGB Members cannot directly bring complaints to the attention of the Disciplinary Committee. The person bringing the complaint to the attention of the Disciplinary Committee is responsible for compiling and submitting the supporting evidence (e.g. reports from EGB Ride Officials; written and oral witness statements; scanned copies or photocopies of documents; photos and videos).\u003c/p\u003e\n\u003cp style=\"margin-left: 39.6pt;\"\u003e4.5.\u0026nbsp;\u0026nbsp;\u0026nbsp; If, in the opinion of the EGB Technical Steward or Ground Jury (as applicable), any person subject to this Disciplinary Code whilst participating in an event is guilty of a Disciplinary Offence as referred to in Paragraph 2.2 of this Code, including:\u003c/p\u003e\n\u003cp style=\"margin-left: 88.65pt;\"\u003ea) \u0026nbsp; Dangerous riding\u003c/p\u003e\n\u003cp style=\"margin-left: 88.65pt;\"\u003eb)\u0026nbsp;\u0026nbsp;\u0026nbsp;\u0026nbsp;\u0026nbsp; Discourteous and unacceptable behaviour (including a lack of respect for the countryside and the land used by the Ride);\u003c/p\u003e\n\u003cp style=\"margin-left: 88.65pt;\"\u003ec)\u0026nbsp;\u0026nbsp;\u0026nbsp;\u0026nbsp;\u0026nbsp;\u0026nbsp; A breach of EGB rules\u003c/p\u003e\n\u003cp style=\"margin-left: 88.65pt;\"\u003ed)\u0026nbsp;\u0026nbsp;\u0026nbsp;\u0026nbsp;\u0026nbsp; Animal abuse\u003c/p\u003e\n\u003cp style=\"margin-left: 42.55pt;\"\u003e\u003cspan class=\"GramE\"\u003ethey\u003c/span\u003e may impose all or any of the following penalties:\u003c/p\u003e\n\u003cp style=\"margin-left: 90pt;\"\u003ea)\u0026nbsp;\u0026nbsp;\u0026nbsp;\u0026nbsp;\u0026nbsp; Take no action\u003c/p\u003e\n\u003cp style=\"margin-left: 90pt;\"\u003eb)\u0026nbsp;\u0026nbsp;\u0026nbsp;\u0026nbsp;\u0026nbsp; A reprimand (verbal or written) and/or downgrade to a lower award\u003c/p\u003e\n\u003cp style=\"margin-left: 90pt;\"\u003ec)\u0026nbsp;\u0026nbsp;\u0026nbsp;\u0026nbsp;\u0026nbsp;\u0026nbsp; Disqualification of the horse and/or rider from taking any further part in the event.\u003c/p\u003e\n\u003cp style=\"margin-left: 36pt;\"\u003eIn addition to the above, if the Technical Steward/Ground Jury (or the EGB Welfare Officer, where relevant) decides to refer the matter to the Disciplinary Committee under this Code, then they shall (within 28 days of the conduct or behaviour) notify the Chair of the Disciplinary Committee in accordance with the procedures set out in the full Disciplinary Code on the EGB website.\u003cstrong\u003e\u003cem\u003e \u003c/em\u003e\u003c/strong\u003e\u003c/p\u003e\n\u003cp style=\"margin-left: 39.6pt;\"\u003e4.6.\u0026nbsp;\u0026nbsp;\u0026nbsp; Other EGB personnel permitted to bring complaints to the attention of the Disciplinary Committee should also follow the procedures and timescales set out in the full Disciplinary Code.\u003c/p\u003e\n\u003cp style=\"margin-left: 39.6pt;\"\u003e4.7.\u0026nbsp;\u0026nbsp;\u0026nbsp; On receipt of a complaint, the Chair of the EGB Disciplinary Committee will convene a three-person Disciplinary Panel from the members of the Disciplinary Committee to consider the complaint. This will be done in accordance with the procedures described in the full Disciplinary Code.\u003c/p\u003e\n\u003cp style=\"margin-left: 39.6pt;\"\u003e4.8.\u0026nbsp;\u0026nbsp;\u0026nbsp; A non-exhaustive list of the steps that may be decided upon by the Disciplinary Panel is as follows:\u003c/p\u003e\n\u003cp style=\"margin-left: 90pt;\"\u003ea)\u0026nbsp;\u0026nbsp;\u0026nbsp;\u0026nbsp;\u0026nbsp; Take no further action\u003c/p\u003e\n\u003cp style=\"margin-left: 90pt;\"\u003eb)\u0026nbsp;\u0026nbsp;\u0026nbsp;\u0026nbsp;\u0026nbsp; Caution or reprimand the Defendant, or issue a formal oral or written warning\u003c/p\u003e\n\u003cp style=\"margin-left: 90pt;\"\u003ec)\u0026nbsp;\u0026nbsp;\u0026nbsp;\u0026nbsp;\u0026nbsp;\u0026nbsp; Fine the Defendant an amount proportionate to the seriousness of the offence (recommended maximum fine = £1,500)\u003c/p\u003e\n\u003cp style=\"margin-left: 90pt;\"\u003ed)\u0026nbsp;\u0026nbsp;\u0026nbsp;\u0026nbsp;\u0026nbsp; The decision of the Disciplinary Committee is final and there is no appeal within EGB (although an aggrieved Member may wish to pursue their complaint with the BEF according to their procedures).\u003c/p\u003e\n\u003cp style=\"margin-left: 39.6pt;\"\u003e5.2.\u0026nbsp;\u0026nbsp;\u0026nbsp; Disciplinary decisions made pursuant to this Code shall not be quashed or held invalid by reason only of any irregularity, omission, technicality or other defect in the procedures followed unless such irregularity, omission, technicality or other defect raises a material doubt as to the reliability of the findings, decision or results in a miscarriage of justice.\u003c/p\u003e\n\u003cp style=\"margin-left: 39.6pt;\"\u003e5.3.\u0026nbsp;\u0026nbsp;\u0026nbsp; In respect of any matter arising that is not provided for in this Code, the appropriate body shall take a decision according to general principles of justice and fairness.\u003c/p\u003e\n\u003cp style=\"margin-left: 39.6pt;\"\u003e5.4.\u0026nbsp;\u0026nbsp;\u0026nbsp; Should a person wish to appeal from a decision of the Technical Steward/Ground Jury made under this paragraph, they may on the deposit of £50 within 28 days of the end of the Event, request that the matter is referred to the EGB Disciplinary Committee.\u0026nbsp; If the appeal is not upheld the deposit is forfeited.\u003c/p\u003e\n\u003cp style=\"margin: 0cm 0cm 0pt 39.6pt;\"\u003e1.3.\u0026nbsp;\u0026nbsp;\u0026nbsp; If the Technical Steward, Ground Jury, Members Liaison Officer, Chef d’Equipe, \u0026nbsp;Lead Welfare Officer or Disciplinary Representative on the EGB Board of Directors decides to refer the matter to the EGB Disciplinary Committee under this Code, then they shall (within 28 days of the conduct of behaviour) send a notice to the Chairman of the Disciplinary Committee (see clause 2.1 below), with a copy to the person being charged (the “Defendant”), which notice shall specify the following:\u003c/p\u003e\n\u003cp style=\"margin: 0cm 0cm 0pt 61.2pt;\"\u003e1.3.1. That the matter is being referred to the Chairman of the Disciplinary Panel for consideration under the Disciplinary Code.\u003c/p\u003e\n\u003cp style=\"margin: 0cm 0cm 0pt 39.6pt;\"\u003e1.4.\u0026nbsp;\u0026nbsp;\u0026nbsp; The person bringing the complaint to the attention of the Disciplinary Committee is responsible for compiling and submitting the supporting evidence (e.g. reports from EGB Ride Officials; written and oral witness statements; scanned copies or photocopies of documents; photos and videos).\u003c/p\u003e\n\u003cp style=\"margin: 0cm 0cm 0pt 39.6pt;\"\u003e1.5.\u0026nbsp;\u0026nbsp;\u0026nbsp; The EGB Disciplinary Committee may deal with any matter referred to it in accordance with the procedure set out in sections 2 and 3 below or, if in its opinion the matter is sufficiently serious, refer it to be dealt with by the officers appointed by the British Equestrian Federation (BEF) Board to consider complaints of misconduct.\u003c/p\u003e\n\u003cp style=\"margin: 0cm 0cm 0pt 39.6pt;\"\u003e\u0026nbsp;\u003c/p\u003e\n\u003cp style=\"margin: 0cm 0cm 0pt 86.4pt;\"\u003e\u0026nbsp;\u003c/p\u003e\n\u003cp style=\"margin: 0cm 0cm 0pt 18pt;\"\u003e\u003cstrong\u003e2.\u0026nbsp;\u0026nbsp;\u0026nbsp;\u0026nbsp;\u0026nbsp;\u0026nbsp; \u003c/strong\u003e\u003cstrong\u003eComposition of the Disciplinary Panel\u003c/strong\u003e\u003c/p\u003e\n\u003cp style=\"margin: 0cm 0cm 0pt 39.6pt;\"\u003e2.1.\u0026nbsp;\u0026nbsp;\u0026nbsp; The Board of Directors of EGB shall designate individuals of suitable experience and standing to form a Disciplinary Committee.\u0026nbsp; For the avoidance of doubt, members of the EGB Board of Directors may be members of the Disciplinary Committee.\u0026nbsp; The Board of Directors of EGB shall designate one of the members of the Disciplinary Committee to serve as Chairman of the Disciplinary Committee.\u003c/p\u003e\n\u003cp style=\"margin: 0cm 0cm 0pt 39.6pt;\"\u003e2.2.\u0026nbsp;\u0026nbsp;\u0026nbsp; When a matter is referred to the Disciplinary Committee under this Code, the Chairman of the Disciplinary Committee shall convene a three-person Disciplinary Panel to hear the complaint.\u003c/p\u003e\n\u003cp style=\"margin: 0cm 0cm 0pt 39.6pt;\"\u003e2.3.\u0026nbsp;\u0026nbsp;\u0026nbsp; No person with a close interest in the matters that are the subject of the complaint may sit on the Disciplinary Panel hearing the complaint.\u003c/p\u003e\n\u003cp style=\"margin: 0cm 0cm 0pt 39.6pt;\"\u003e2.4.\u0026nbsp;\u0026nbsp;\u0026nbsp; Once the Disciplinary Panel has been convened, its Chairman shall send a written notice to the Defendant, identifying the members of the Disciplinary Panel and specifying a deadline by which any challenges to its composition based on clause 2.3 above must be made and then:\u003c/p\u003e\n\u003cp style=\"margin: 0cm 0cm 0pt 61.2pt;\"\u003e2.4.1. Offer the Defendant the right of reply in writing to the charges made within 10 days, following which the Disciplinary Panel will confer together and notify the Defendant in writing of their provisional findings and offer a Disciplinary Hearing at a later date during which a final decision will be made and any sanction(s) will be imposed; or\u003c/p\u003e\n\u003cp style=\"margin: 0cm 0cm 0pt 61.2pt;\"\u003e2.4.2. Allow the Defendant to choose to attend a Disciplinary Hearing at a time convenient to the Disciplinary Panel without making any written reply.\u0026nbsp; If no written reply is received from the Defendant within the specified period, a Disciplinary Hearing will be convened at which the Defendant will be required to attend.\u0026nbsp; The Defendant will be notified in writing of the details of the Disciplinary Hearing and will be asked to inform the Disciplinary Panel whether or not they choose to attend.\u0026nbsp; The Defendant will be notified that if they choose not to attend, the Disciplinary Panel will confer together in their absence and subsequently notify the Defendant in writing of their findings and any sanction(s).\u003c/p\u003e\n\u003cp style=\"margin: 0cm 0cm 0pt 61.2pt;\"\u003e2.4.3. The Defendant may admit the charge at any time, in which case the Disciplinary Panel shall proceed immediately to consider submissions as to what sanction(s), if any, should be imposed, without the need for a Disciplinary Hearing (providing the Defendant agrees that it is not necessary to hold one).\u003c/p\u003e\n\u003cp style=\"margin: 0cm 0cm 0pt 39.6pt;\"\u003e2.5.\u0026nbsp;\u0026nbsp;\u0026nbsp; If a member of a Disciplinary Panel is unable or unwilling, for whatever reason, to hear the complaint, then the Chairman of the Disciplinary Committee may, in their absolute discretion (a) appoint another member of the Disciplinary Committee as a replacement; or (b) appoint a new Disciplinary Panel.\u003c/p\u003e\n\u003cp style=\"margin: 0cm 0cm 0pt 39.6pt;\"\u003e2.6.\u0026nbsp;\u0026nbsp;\u0026nbsp; A Disciplinary Panel shall be entitled to call on experts to provide specialist advice, including legal advice, without such experts sitting as members of the Disciplinary Panel.\u0026nbsp; The costs of such experts shall be costs of the proceedings, for the purposes of clause 4.5 below.\u003c/p\u003e\n\u003cp style=\"margin: 0cm 0cm 0pt 18pt;\"\u003e\u0026nbsp;\u003c/p\u003e\n\u003cp style=\"margin: 0cm 0cm 0pt 18pt;\"\u003e\u003cstrong\u003e3.\u0026nbsp;\u0026nbsp;\u0026nbsp;\u0026nbsp;\u0026nbsp;\u0026nbsp; \u003c/strong\u003e\u003cstrong\u003eProceedings before the Disciplinary Panel\u003c/strong\u003e\u003c/p\u003e\n\u003cp style=\"margin: 0cm 0cm 0pt 42.55pt;\"\u003e3.1.\u0026nbsp;\u0026nbsp;\u0026nbsp;\u0026nbsp;\u0026nbsp; The Defendant\u003cstrong\u003e, \u003c/strong\u003eif requested, must present himself/herself before the Disciplinary Panel.\u0026nbsp; The Defendant will be notified of the Hearing by first class post.\u0026nbsp; Failure to attend may result in the Hearing proceeding in their absence.\u003c/p\u003e\n\u003cp style=\"margin: 0cm 0cm 0pt 42.55pt;\"\u003e3.2.\u0026nbsp;\u0026nbsp;\u0026nbsp;\u0026nbsp;\u0026nbsp; The procedures applicable in respect of the Hearing before the Disciplinary Panel shall be determined by the Disciplinary Panel as it shall see fit, provided always that such procedures shall be consistent with the requirements of fairness.\u0026nbsp; The procedures shall be advised to the parties at the beginning of the Hearing, and the parties shall be entitled to propose amendments to the procedures in the particular circumstances of that case.\u003c/p\u003e\n\u003cp style=\"margin: 0cm 0cm 0pt 42.55pt;\"\u003e3.3.\u0026nbsp;\u0026nbsp;\u0026nbsp;\u0026nbsp;\u0026nbsp; It is hereby acknowledged that requirements of fairness are not fixed, but depend for their content on the particular facts and circumstances of the case in question.\u0026nbsp; Nevertheless, they shall usually include at a minimum the following:\u003c/p\u003e\n\u003cp style=\"margin: 0cm 0cm 0pt 61.2pt;\"\u003e3.3.1. The Defendant shall be entitled to be accompanied at the Hearing by a person of his choice (such as a legal advisor, whose costs shall be the costs of the proceedings for the purposes of clause 4.5 below), who may speak on behalf of the Defendant.\u0026nbsp; The Defendant and his chosen person shall be entitled to be present for the whole of the Hearing other than the private deliberations of the Disciplinary Panel.\u003c/p\u003e\n\u003cp style=\"margin: 0cm 0cm 0pt 61.2pt;\"\u003e3.3.2. The Technical Steward, Ground Jury, Members Liaison Officer, Chef d’Equipe,\u0026nbsp; Lead Welfare Officer or Disciplinary Representative on the EGB Board of Directors shall bear the burden of proving, on the balance of probabilities, that the Defendant has committed a Disciplinary Offence.\u0026nbsp; They may be assisted by legal counsel, whose costs shall be the costs of the proceedings for purposes of clause 4.5 below.\u003c/p\u003e\n\u003cp style=\"margin: 0cm 0cm 0pt 61.2pt;\"\u003e3.3.3. The Defendant may admit the charge at any time, in which case the Disciplinary Panel shall proceed immediately to hear submissions as to what sanctions (if any) should be imposed.\u003c/p\u003e\n\u003cp style=\"margin: 0cm 0cm 0pt 61.2pt;\"\u003e3.3.4. The members of the Disciplinary Panel may ask the Defendant questions.\u0026nbsp; In addition, the Technical Steward, Ground Jury, Members Liaison Officer, Chef d’Equipe, Lead Welfare Officer or Disciplinary Representative on the EGB Board of Directors may ask the Defendant questions through the Chairman of the Disciplinary Panel.\u0026nbsp; The Defendant may be required to answer such questions and to give such explanations for their conduct as requested by the Disciplinary Panel.\u003c/p\u003e\n\u003cp style=\"margin: 0cm 0cm 0pt 61.2pt;\"\u003e3.3.5. The Technical Steward, Ground Jury, Members Liaison Officer, Chef d’Equipe, Lead Welfare Officer or Disciplinary Representative on the EGB Board of Directors may present oral, written or video evidence from third parties.\u0026nbsp; In such a case the Defendant (or his representative) shall be given a reasonable opportunity to cross-examine (through the Chairman of the Disciplinary Panel) those who have given oral evidence and to make representations as to the contents of any written or video evidence.\u003c/p\u003e\n\u003cp style=\"margin: 0cm 0cm 0pt 61.2pt;\"\u003e3.3.6. If the Technical Steward, Ground Jury, Members Liaison Officer, Chef d’Equipe, Lead Welfare Officer or Disciplinary Representative on the EGB Board of Directors establishes a prima facie case of a Disciplinary Offence, the Defendant shall be given proper opportunity to state his defence to the Disciplinary Panel before any decision is taken.\u003c/p\u003e\n\u003cp style=\"margin: 0cm 0cm 0pt 61.2pt;\"\u003e3.3.7. The Defendant may present oral, written or video evidence, in which case the Technical Steward, Ground Jury, Members Liaison Officer, Chef d’Equipe, Lead Welfare Officer or Disciplinary Representative on the EGB Board of Directors shall be given a reasonable opportunity (through the Chairman of the Disciplinary Panel) to cross-examine such witnesses and to make representations as to the contents of any written or video evidence.\u003c/p\u003e\n\u003cp style=\"margin: 0cm 0cm 0pt 61.2pt;\"\u003e3.3.8. The Disciplinary Panel shall seek, where possible, to obtain first-hand evidence of matters in issue rather than hearsay evidence.\u0026nbsp; However, formal legal rules regarding the admissibility of evidence shall not apply in proceedings before the Disciplinary Panel.\u0026nbsp; Instead, the Disciplinary Panel shall decide in its absolute discretion what weight, if any, to give to the evidence presented to it.\u003c/p\u003e\n\u003cp style=\"margin: 0cm 0cm 0pt 61.2pt;\"\u003e3.3.9. The Disciplinary Panel shall decide all of the issues presented to it fairly and impartially.\u003c/p\u003e\n\u003cp style=\"margin: 0cm 0cm 0pt 39.6pt;\"\u003e3.4.\u0026nbsp;\u0026nbsp;\u0026nbsp; The Chairman of the Disciplinary Panel shall be entitled to suspend or adjourn the Hearing for the purposes of investigating any matters arising in the course of the Hearing or for any other reason.\u0026nbsp; Such suspension or adjournment shall last only for as long as shall be reasonably necessary.\u003c/p\u003e\n\u003cp style=\"margin: 0cm 0cm 0pt 18pt;\"\u003e\u003cstrong\u003e\u0026nbsp;\u003c/strong\u003e\u003c/p\u003e\n\u003cp style=\"margin: 0cm 0cm 0pt 18pt;\"\u003e\u003cstrong\u003e\u0026nbsp;\u003c/strong\u003e\u003c/p\u003e\n\u003cp style=\"margin: 0cm 0cm 0pt 18pt;\"\u003e\u003cstrong\u003e4.\u0026nbsp;\u0026nbsp;\u0026nbsp;\u0026nbsp;\u0026nbsp;\u0026nbsp; \u003c/strong\u003e\u003cstrong\u003eDecisions by the Disciplinary Panel\u003c/strong\u003e\u003c/p\u003e\n\u003cp style=\"margin: 0cm 0cm 0pt 39.6pt;\"\u003e4.1.\u0026nbsp;\u0026nbsp;\u0026nbsp; At the conclusion of the Disciplinary Hearing, the Disciplinary Panel shall confer in private in order to reach a decision.\u0026nbsp; Decisions of the Disciplinary Panel shall be made by majority vote, without right to abstain.\u003c/p\u003e\n\u003cp style=\"margin: 0cm 0cm 0pt 39.6pt;\"\u003e4.2.\u0026nbsp;\u0026nbsp;\u0026nbsp; Where the Disciplinary Panel is satisfied on the balance of probabilities that the Defendant has committed a Disciplinary Offence, then (subject to clause 4.4 below), the Disciplinary Panel shall impose such sanction(s) as it shall see fit (if any).\u0026nbsp; In its discretion it may invite submissions from the parties as to what sanctions (if any) should be imposed.\u003c/p\u003e\n\u003cp style=\"margin: 0cm 0cm 0pt 39.6pt;\"\u003e4.3.\u0026nbsp;\u0026nbsp;\u0026nbsp; Subject to clause 4.4 below, a non-exhaustive list of the steps that may be decided upon by the Disciplinary Panel is as follows:\u003c/p\u003e\n\u003cp style=\"margin: 0cm 0cm 0pt 61.2pt;\"\u003e4.3.1. Take no further action;\u003c/p\u003e\n\u003cp style=\"margin: 0cm 0cm 0pt 61.2pt;\"\u003e4.3.2. Caution or reprimand the Defendant, or issue a formal oral or written warning;\u003c/p\u003e\n\u003cp style=\"margin: 0cm 0cm 0pt 61.2pt;\"\u003e4.3.3. Fine the Defendant in an amount proportionate to the seriousness of the offence (recommended maximum fine = £1,000);\u003c/p\u003e\n\u003cp style=\"margin: 0cm 0cm 0pt 61.2pt;\"\u003e4.3.4. Suspend the Defendant from participation in one or more EGB Rides or from membership of EGB for a specified period; and/or\u003c/p\u003e\n\u003cp style=\"margin: 0cm 0cm 0pt 61.2pt;\"\u003e4.3.5. Expel the Defendant from membership of EGB.\u003c/p\u003e\n\u003cp style=\"margin: 0cm 0cm 0pt 39.6pt;\"\u003e4.4.\u0026nbsp;\u0026nbsp;\u0026nbsp; Where a complaint is upheld that the Defendant has reneged on a commitment to participate in an EGB team to contest a major championship or competition, the sanction shall be suspension from membership of EGB for a period of not more than eighteen months, commencing on the date of the Championship in question.\u0026nbsp; Proof of mitigating circumstances will be required in order to justify reducing the length of the sanction in such cases to less than eighteen months.\u003c/p\u003e\n\u003cp style=\"margin: 0cm 0cm 0pt 39.6pt;\"\u003e4.5.\u0026nbsp;\u0026nbsp;\u0026nbsp; In its decision, the Disciplinary Panel shall have discretion to impose any order that it shall see fit as to the costs of proceedings before it.\u003c/p\u003e\n\u003cp style=\"margin: 0cm 0cm 0pt 39.6pt;\"\u003e4.6.\u0026nbsp;\u0026nbsp;\u0026nbsp; The Chairman shall inform the Defendant of the Disciplinary Panel’s decision, including the reasons for it, in writing, posted by normal first class post within 48 hours of the decision being made.\u0026nbsp; The decision shall be binding upon notification to the Defendant.\u0026nbsp; EGB may publicise the decision after it has been notified to the Defendant.\u003c/p\u003e\n\u003cp style=\"margin: 0cm 0cm 0pt 39.6pt;\"\u003e4.7.\u0026nbsp;\u0026nbsp;\u0026nbsp; The decision of the Disciplinary Panel is final and there is no appeal within EGB (although an aggrieved Member may wish to pursue their complaint with the BEF according to their procedures).\u003c/p\u003e\n\u003cp style=\"margin: 0cm 0cm 0pt 39.6pt;\"\u003e\u0026nbsp;\u003c/p\u003e\n\u003cp style=\"margin: 0cm 0cm 0pt 18pt;\"\u003e\u003cstrong\u003e5.\u0026nbsp;\u0026nbsp;\u0026nbsp;\u0026nbsp;\u0026nbsp;\u0026nbsp; \u003c/strong\u003e\u003cstrong\u003eMiscellaneous\u003c/strong\u003e\u003c/p\u003e\n\u003cp style=\"margin: 0cm 0cm 0pt 39.6pt;\"\u003e5.1.\u0026nbsp;\u0026nbsp;\u0026nbsp; Disciplinary decisions made pursuant to this Code shall not be quashed or held invalid by reason only of any irregularity, omission, technicality or other defect in the procedures followed unless such irregularity, omission, technicality or other defect raises a material doubt as to the reliability of the findings, decisions or results in a miscarriage of justice.\u003c/p\u003e\n\u003cp style=\"margin: 0cm 0cm 0pt 39.6pt;\"\u003e5.2.\u0026nbsp;\u0026nbsp;\u0026nbsp; In respect of any matter arising that is not provided for in this Code, the appropriate body shall take a decision according to general principles of justice and fairness.\u003c/p\u003e\n\u003cp style=\"margin: 0cm 0cm 10pt 39.6pt;\"\u003e5.3.\u0026nbsp;\u0026nbsp;\u0026nbsp; Disciplinary findings or decisions made pursuant to this Code may be published in the EGB magazine.\u003c/p\u003e\n\u003cp style=\"margin: 0cm 0cm 10pt;\"\u003e\u003cem\u003e(Prepared by Diana Sanderson, Chair of EGB Disciplinary Committee)\u003c/em\u003e\u003c/p\u003e\n\u003cp\u003e\u0026nbsp;\u003c/p\u003e","ComponentCode":null,"ComponentData":null,"ComponentError":null,"Background":{"Colour":null,"ImageURL":null,"ImageCrop":null,"Filter":null,"Html":"\u003cdiv class=\"cms-image\"\u003e\u003c/div\u003e"}}],"Height":0,"ColumnSpacing":0,"BottomMargin":0,"IsFullWidth":false,"IsBackgroundFullWidth":false,"Background":{"Colour":null,"ImageURL":null,"ImageCrop":null,"Filter":null,"Html":"\u003cdiv class=\"cms-image\"\u003e\u003c/div\u003e"}}],"PageURL":"https://egb.myclubhouse.co.uk/Cms/Spaces/RULES/Disciplinary?version=3","AllVersions":[{"ID":259,"Name":"v1 - RULES - Disciplinary - Elizabeth Hinings - 01/12/2019 14:00"},{"ID":274,"Name":"v2 - Disciplinary - John Hudson - 02/12/2019 14:51"},{"ID":362,"Name":"v3 - Disciplinary - Elizabeth Hinings - 05/12/2019 15:01"}],"Comments":[],"UpdatedComments":[],"Spaces":[],"IsWatching":false,"LastViewTime":null,"CanEdit":false,"CanPublish":false,"CanComment":false,"CanReadComments":false,"CanModerateComments":false,"CanLike":false,"CanWatch":false}
